It's hard to fight for victim's rights when state and local lawmakers take money from private, anti-bail forces and then try and ram through legislation nobody wants. But when the courts enter the fray and write their own anti-bail laws, the struggle for justice becomes next to impossible. That's what's happening in Missouri. The Missouri supreme court, mistaking itself for a legislative body, has decided to eliminate the bail bonds system in the...

But because power tends to corrupt many of those public servants forget that they are servants and start listening more to wealthy campaign contributors than to the people they are sworn to serve. This is how special interests wrest control of the people's government from the people. One such special interest is the Arnold...

The High Cost of the No-Bail State of America

Proponents of so-called “bail reform” are fond of touting the alleged benefits of a world without bail bonds. To these short-sighted individuals bail is responsible for everything from climate change to the loss of manufacturing jobs and everything in between. But one thing proponents of the bail-less system aren’t so eager to talk about is how many new fugitives the bail free system is creating on a daily basis. It seems that once people rea...

Hand crossing out 'MYTHS' on chalkboard with 'FACTS' written just above

The quest to undermine the bail bonds system that has worked effectively for a nearly a thousand years has been a multi-pronged effort. If you put this effort under a microscope however, you discover it has three essential components:

  1. The non-profits that need to manufacture issues to champion.
  2. The lobbyists who are paid by the non-profits to strong-arm legislators.
  3. And then there are the minions of the media who know that “controversy...

Bail Reform Reality Check Ahead

In 2017 New Jersey effectively did away with the cash bail bonds system. In its place they adopted a computer program that decided whether defendants should be held for trial or released without bail. In the two years since supporters of the change have scrambled to come up with any statistic they can find (or manufacture) to bolster the fantasy that this change has been good for the Garden State. Most of the arguments in favor of keeping the...

Another Effort at Bail Reform Goes off the Rails

To that last point there are many ways that attempts to eliminate the bondsman has cre...

Anytime you bail out a friend or loved one you’re taking a chance. If the accused heads for the hills after being released and is never heard from again you are going to lose and lose big. If you paid cash instead of using a bondsman that cash will be forfeited. If you posted a property bond the court may foreclose on your house and sell it to get the bail amount, and if you enlisted the help of a bail bonds agent they are going to come knockin...

When a person has been arrested there’s a lot going through their mind and it can sometimes be difficult to take a step back, take a breath and make sound decisions. One mistake a lot of people who have been arrested in Denver County, Golden, and elsewhere in Colorado make is deciding to act as their own bail bond agent by paying their own bail. Certainly, if they have the means it’s entirely legal for them to do so, but just because you can...

Although those in favor of eliminating the centuries-old bail bonds system suffered a much deserved setback last year in the Colorado state senate, that hasn’t stopped them from trying to saddle taxpayers with their backward, short-sighted ideas. In fact, as you read this lobbyists are working the corridors of power in Denver trying to get legislators behind new efforts to eliminate cash bail. In its stead they propose using a deeply flawed com...
